Who we are and what these terms cover

Nehoa LLC (“Nehoa”, “we”, “us”) is a Georgia limited liability company at 322 W Main St Unit 1A, Blue Ridge, GA 30513. We buy and sell pre-owned luxury watches through nehoa.com (the “Site”), by phone and email, and in person at our locations.

These Terms and Conditions (“Terms”) apply to your use of the Site and to every purchase from us and every sale to us. Our Shipping & Returns policy and Privacy Policy are part of these Terms. If you and Nehoa sign a separate written agreement for a particular transaction, that agreement controls where it conflicts with these Terms.

Agreeing to these terms

You accept these Terms when you place an order on the Site, accept an offer from us by phone, text or email, or complete a transaction in person. If you don’t agree with them, please don’t buy from or sell to us.

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate information, including your legal name, a valid government ID when we ask for one, and a Verified Address for delivery.
  • We may decline or cancel any order or offer, including where we suspect fraud, identity misuse, resale by an unauthorized dealer, or a stolen watch.

Our watches

  • Pre-owned. Unless a Listing says “unworn”, every watch we sell is pre-owned and may show wear consistent with its stated condition grade. Our grades (Unworn, Excellent, Very Good, Good) are defined in the FAQ and form part of the Listing.
  • Genuine. Every watch is authenticated in-house before it is listed and again before it ships. We guarantee it is Genuine as set out in section 10. Where a watch contains a non-factory part (an aftermarket bezel insert or a service dial, for example), the Listing says so.
  • Independent dealer. Nehoa is an independent watch dealer. We are not an authorized dealer for any brand we buy or sell and have no affiliation with any manufacturer. Brand and model names are used only to identify the watches. Factory warranties are honored by the manufacturer at its discretion, not by us.
  • Photos and descriptions. Our photos are of the actual watch. Colors may vary slightly between screens. Measurements and specifications are given in good faith from the manufacturer’s published data or our own measurement.
  • Water resistance. Pre-owned watches have not been pressure-tested by us unless the Listing says so. Treat any water-resistance rating as the original factory rating, not a current guarantee, until the watch has been serviced and tested.
  • Reference prices. Where we show a retail or market price alongside ours, it is for comparison and may be out of date.

Orders and pricing

  • When a sale is final. Placing an order is an offer to buy. A contract forms when we accept the order and your payment has cleared. We confirm by email.
  • No reservations. Adding a watch to your cart doesn’t reserve it, and we can’t hold items. The first order to complete payment gets the watch.
  • Errors. If a watch is listed at an obviously wrong price or with a material error in the description, we may cancel the order and refund you in full, even after confirmation.
  • Sales tax. Prices exclude sales tax. We collect tax where the law requires, based on the delivery address, and show it at checkout.
  • Verification. We may ask you to verify your identity and payment before shipping, including a copy of your government ID. If we can’t verify an order, we cancel and refund it.

Payment

We accept wire transfer, major credit cards and cryptocurrency, as described in our Shipping & Returns policy. In addition:

  • Card payments carry a processing fee calculated and shown at checkout. We require a copy of a valid driver’s license or other government ID matching the cardholder, and we ship only to the card’s billing address.
  • Wire fraud warning. Our wire instructions never change by email. If you receive an email asking you to send a wire to new or different details, do not send it; call us at (706) 230-5253 to confirm. We are not responsible for funds wired to an account that isn’t ours.
  • Cryptocurrency payments are final once confirmed on the network. The amount due is fixed in U.S. dollars at the time we issue the payment request and is valid for the window stated in that request.
  • Chargebacks. If you have a problem with an order, contact us before disputing a charge with your card issuer; we resolve almost everything directly. A chargeback filed on a watch you have received and kept is a breach of these Terms, and we may recover the amount, our costs and the watch.
  • Reporting. We file any reports that federal law requires for large transactions, including anti-money-laundering reports that apply to dealers in jewelry and precious metals.

Shipping and delivery

  • Domestic orders ship free, overnight, fully insured, by FedEx, with an adult signature required, to the Verified Address. Full details, including cutoff times and what to do if a package is damaged or missing, are in our Shipping & Returns policy.
  • We ship every properly completed order within 30 days of payment clearing, and almost always the same or next Business Day.
  • Risk of loss passes to you at Delivery. Until then, the watch is insured by us. If you redirect, hold or release a shipment without a signature through your own FedEx account, risk passes when FedEx releases it under your instruction.
  • We ship to addresses in the United States. International sales, where we agree to them, are arranged individually; you are responsible for any duties, import taxes and local compliance.

Pickup in Blue Ridge

  • Online purchases may be collected at our Blue Ridge, Georgia office by appointment. Bring a government ID matching the name on the order; we release a watch only to the buyer or a person the buyer has authorized in writing in advance.
  • Please collect within 30 days of our notice that the watch is ready. After that we may ship it to your Verified Address instead.
  • Delivery, and the start of the Inspection Period, occurs when you take possession at our office.
  • Visits are private and by appointment; for everyone’s safety we may ask you to confirm your identity before entry, and our premises are monitored.

Returns and refunds

All sales are final except as set out here and in our Shipping & Returns policy.

  • If a watch doesn’t match its Listing, tell us within the Inspection Period (48 hours after Delivery). Once we authorize the return, ship it on the prepaid, insured label we provide within 2 Business Days.
  • The watch must come back in the condition it arrived, unworn beyond trying it on, with everything that shipped with it. Watches that have been sized, worn, serviced or opened after Delivery can’t be returned.
  • We don’t accept returns for a change of mind, for fit, or for wear covered by the stated condition grade.
  • Approved refunds go to the original payment method, as described in the Shipping & Returns policy.

Authenticity guarantee and disclaimers

Our guarantee

We guarantee that every watch we sell is Genuine, and that any non-factory part is disclosed in the Listing. If a qualified independent watchmaker or the manufacturer determines that a watch we sold you is not Genuine, or contains an undisclosed non-factory case, movement or dial, we will refund the full purchase price on return of the watch, whenever that is, and reimburse reasonable documented authentication costs up to $500. This guarantee is personal to the original buyer.

What we don’t promise

  • Except for the guarantee above and the Listing itself, watches are sold as described, and Vintage watches and non-watch items are sold as is, with all faults.
  • To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Some states don’t allow this, so these limits may not fully apply to you.
  • We don’t offer a separate mechanical warranty. Any remaining manufacturer’s warranty is noted in the Listing and is provided by the manufacturer, not us.
  • Having a watch serviced or modified by anyone else is your choice; we aren’t responsible for the results, and our guarantee doesn’t cover parts fitted after Delivery.

Selling your watch to Nehoa

When you sell to us, the roles reverse, and so do the promises.

What you promise

  1. You own the watch outright. It isn’t stolen, lost, subject to a loan, lien, pawn or payment plan, or claimed by anyone else, and you have the right to sell it.
  2. Your description is accurate and complete, including condition, service history you know of, non-factory parts, and whether box, papers and accessories are included.
  3. You are at least 18 and will provide a valid government ID so we can meet our record-keeping obligations.

How the sale works

  • An Offer is based on your description and photos and is valid for 7 days unless we say otherwise. It is conditional on the watch matching that description when we inspect it.
  • Shipping to us is free and insured on the label we provide; see our Shipping & Returns policy for packing instructions. Risk of loss passes to us when FedEx scans the package in.
  • If the watch matches, we confirm the Offer and pay by wire. Title passes to us when payment is sent.
  • If the watch differs from your description, we’ll call you with a revised Offer. You can accept it or decline, and we return the watch to you free and insured.
  • If a watch is reported stolen, we cooperate with law enforcement, which may include holding the watch and sharing your details, and we may rescind the sale and recover any payment made.

Limitation of liability

To the fullest extent the law allows, Nehoa’s total liability to you for any claim arising out of a transaction or your use of the Site is limited to the amount you paid us for the watch concerned, or $1,000 if that is greater. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost opportunity, even if we were told they were possible.

Nothing in these Terms limits liability that can’t be limited by law, including for fraud, gross negligence or wilful misconduct, or any liability under our authenticity guarantee in section 10.

Dispute resolution

Please read this section carefully

It requires most disputes to be resolved by individual arbitration rather than in court, and it waives jury trials and class actions. You can opt out within 30 days of your first transaction with us.

  1. Talk to us first. Before starting any formal proceeding, email admin@nehoa.com with your name, contact details, order details and what you want. We’ll do the same if we have a claim against you. Both sides agree to try in good faith to resolve the matter for 30 days.
  2. Arbitration. If we can’t resolve it informally, any dispute arising out of these Terms, the Site, or a purchase from or sale to Nehoa will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator decides everything, including whether a claim is arbitrable. Arbitration takes place in Fannin County, Georgia, or by video or phone, or in writing for smaller claims, as the rules allow.
  3. Fees. For claims of $10,000 or less, Nehoa pays the AAA filing and arbitrator fees unless the arbitrator finds the claim frivolous. Each side pays its own lawyers unless the law or the arbitrator says otherwise.
  4. Individual claims only. Claims are brought and resolved individually. Neither of us may bring or join a class, collective or representative action, and the arbitrator may not consolidate claims of different people. If this paragraph is found unenforceable for a particular claim, that claim goes to court, and the rest of this section still applies to everything else.
  5. Jury waiver. To the extent any claim does proceed in court, both sides waive the right to a jury trial.
  6. Small claims. Either side may bring an individual claim in small claims court in Fannin County, Georgia, or in your home county, instead of arbitration.
  7. Opt-out. You may opt out of arbitration by emailing admin@nehoa.com with the subject “Arbitration opt-out” and your name and order details within 30 days of your first transaction with Nehoa. Opting out doesn’t affect any other part of these Terms.
  8. Governing law and venue. These Terms and any dispute are governed by the laws of the State of Georgia and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. Any court proceeding permitted under this section takes place in the state or federal courts for Fannin County, Georgia, and both sides consent to that jurisdiction.
  9. Time limit. Any claim must be started within one year of the event giving rise to it, unless the law doesn’t allow that period to be shortened.

Using the site

  • Our content. The Site, its text, photos, videos, logos and design belong to Nehoa or our licensors. You may view it and print pages for your own use. You may not copy our photos or descriptions to list watches elsewhere, scrape the Site, or use our name or logo without written permission.
  • Your account. If you create an account, keep your password private and tell us if you think it has been compromised. You’re responsible for activity under your account.
  • Reviews and messages you send us. You give us a non-exclusive, royalty-free, perpetual license to use reviews, photos and comments you submit or post publicly about Nehoa, including on our Site and in marketing, with your first name and last initial. Tell us if you’d rather we didn’t.
  • Prohibited conduct. Don’t use the Site to do anything unlawful, interfere with its operation, attempt to access other people’s data, place fraudulent orders, or submit false information about a watch you’re selling.
  • Third parties. The Site links to and embeds services from YouTube, Google, Trustpilot and others. Their content and terms are theirs, not ours.
  • Availability. The Site is provided as is and as available. We do our best to keep it accurate and online but don’t guarantee it will be error-free or uninterrupted.

Indemnity

You agree to defend and indemnify Nehoa and its owners, employees and agents against claims, losses and reasonable legal costs arising from your breach of these Terms, your violation of the law or someone else’s rights, a false statement you make about a watch you sell us (including as to ownership), or your misuse of the Site.

Communications

When you buy from or sell to us, you agree that we may email, call or text you about that transaction, including order confirmations, shipping updates, offer details and identity verification. Marketing emails are sent only if you subscribe or buy from us, and every one has an unsubscribe link. We don’t send marketing text messages without your separate consent. Our Privacy Policy explains how we handle your information.

Changes to these terms

We may update these Terms from time to time. The version in effect when you place an order or accept an Offer governs that transaction. Changes are posted on this page with a new effective date, and if a change materially affects your rights we’ll give notice on the Site or by email. Continuing to use the Site after a change means you accept it.

General

  • Entire agreement. These Terms, with the policies they incorporate and any written agreement for a specific transaction, are the whole agreement between you and Nehoa about their subject.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect and the unenforceable part is enforced to the maximum extent allowed.
  • No waiver. If we don’t enforce a provision, we haven’t given up the right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may assign them to a successor to our business.
  • Force majeure. Neither side is liable for delay caused by events outside its reasonable control, such as carrier failures, severe weather, strikes or government action, except that payment obligations aren’t excused.
  • Survival. Sections 10 through 15 and 18 survive the completion of any transaction.
  • California residents. Under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
